These Terms govern your use of Lumina AI Creator Studio (the "Service"), operated by Lumina Marketing Agency LLC. By signing in you agree to these Terms.
1. Eligibility
- You must be ≥ 18 years old (or the age of majority in your jurisdiction).
- For NSFW / Fanvue mode: ≥ 21 with explicit age verification.
- You must have authority to bind the entity you represent (if any).
2. Accounts
You are responsible for your credentials. Notify us at support@luminamarketing.agency immediately of unauthorized use.
3. Subscriptions & Credits
- Plans: Free, Starter ($9/mo), Pro ($29/mo), Business ($99/mo), Ultra ($499/mo).
- 1-time credit packs available. Unused subscription credits roll over up to 2 cycles.
- Billing is monthly in advance via Stripe. Charges are non-refundable except as required by law.
- You may cancel any time — access continues until end of paid period.
- Failed payments may suspend access until resolved.
4. Acceptable Use
You agree NOT to:
- Generate or upload CSAM, content depicting minors in sexual contexts, or any illegal content.
- Create deepfakes of real individuals without their explicit written consent.
- Impersonate public figures, politicians, or living persons in misleading contexts.
- Generate non-consensual intimate imagery (NCII).
- Use the Service to harass, defraud, blackmail, or commit hate speech.
- Reverse-engineer, scrape, or abuse rate limits.
- Resell credits or sub-license API access without our written agreement.
Violations may result in immediate suspension, forfeiture of credits, and legal referral.
5. Your Content
- You retain ownership of reference photos you upload and outputs you generate.
- You grant us a worldwide, royalty-free license solely to operate the Service (store, process, deliver outputs to you).
- You warrant you have all necessary rights to the reference photos.
6. AI Content & Watermarking
Outputs are AI-generated. We apply an AI Generated watermark by default. You agree to disclose AI provenance when posting to platforms that require it (e.g., TikTok, Meta, YouTube AI content disclosure rules).
7. Platform Compliance
When publishing to Facebook, Instagram, TikTok, YouTube, Fanvue, or any third party, you remain solely responsible for complying with that platform's terms (including community guidelines, AI labeling, and age-gating rules).
8. Fanvue / NSFW Tier
- NSFW outputs are watermarked and audit-logged for 7 years.
- You confirm all depicted personas are fictional adults ≥ 21.
- CSAM detection runs automatically; positive hits suspend the account and trigger legal reporting.
9. Third-Party Services
The Service depends on Google Firebase, RunPod GPU, Stripe, and (optionally) Telegram + Google Drive. Their terms also apply. We are not responsible for third-party outages.
10. Service Availability
The Service is provided "as-is". We target 99% monthly uptime but do not guarantee it. GPU cold starts may add up to 60 seconds. Render quality depends on the model selected.
11. Intellectual Property
The Service code, brand, and design are owned by Lumina Marketing Agency LLC. You receive only a limited license to use the Service per these Terms.
12. Termination
We may suspend or terminate accounts for violations. You may close your account anytime in Settings — see Data Deletion.
13. Disclaimers
NO WARRANTIES, EXPRESS OR IMPLIED. NO GUARANTEE OF FITNESS FOR A PARTICULAR PURPOSE. AI OUTPUTS MAY CONTAIN ERRORS, ARTIFACTS, OR BIAS.
14. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability shall not exceed the fees you paid us in the 12 months preceding the claim.
15. Indemnification
You will defend and indemnify us against any claim arising from your content, your use of outputs, or your violation of these Terms.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict of laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware, USA.
17. Changes
We may revise these Terms. Material changes will be notified in-product. Continued use after changes means acceptance.
